What is an Employer of Record (EOR)?

Our Employer of Record (EOR) service allows your business to legally employ staff in the Philippines without needing to set up a local entity. Benchmark 365 becomes the official employer on paper, while you retain full control over day-to-day work, performance, and outcomes.

Where do you provide EOR services?

We currently offer Employer of Record services exclusively in the Philippines.

Do you provide recruitment?

No. You source your own candidate, and we step in to employ them legally, manage payroll, 
and ensure full compliance with Philippine labor laws.

What does your EOR service cover?

Our service includes legal employment under our entity, employment contracts based on 
Philippine law, payroll administration and salary disbursement, government reporting and 
remittances (tax, SSS, PhilHealth, Pag-IBIG), statutory benefits plus optional HMO coverage, 
and handling of end-of-contract processing such as resignations, terminations, and clearances. 
We do not provide onboarding, employee engagement, performance management, or 
disciplinary processes - those remain under your control.

What types of employment do you support?

We can employ full-time, part-time, fixed-term, probationary, and contractor roles - whatever 
structure best suits your needs.

Who manages contracts and policies?

All employees are hired under Benchmark 365’s standard contracts and policies, carefully 
drafted to meet Philippine legal requirements.

Who leads HR decisions like promotions or terminations?

You do. Clients maintain control over promotions, salary adjustments, discipline, and 
termination decisions. Benchmark 365 ensures these are executed compliantly.

Do you provide legal representation in disputes?
No. We process the necessary paperwork, but legal disputes and representation remain the 
responsibility of the client.
How do you handle intellectual property (IP)?
Our agreements include automatic IP assignment, ensuring that all work product belongs to you, the client.
What benefits do you provide?
Statutory benefits required by Philippine law (SSS, PhilHealth, Pag-IBIG, leave entitlements). 
Optional HMO health insurance is also available under a standard package.
Can you support additional perks or leave policies?
Yes. If you would like to extend benefits such as extra vacation days, flexible leave, or 
allowances, we can administer those for you.
How do you handle payroll and billing?
We bill clients in AUD or USD with a fixed service fee, invoiced one month in advance. 
Employee and contractor salaries adjust with exchange rates. If currency fluctuations exceed 
±5 percent for more than two consecutive months, fees are reviewed. One consolidated invoice covers both our fee and employee costs. Clients pay Benchmark 365, and we pay employees directly into their Philippine accounts.
Do you handle reimbursements and expenses?
Yes. We can process employee reimbursements through payroll, making it simple to manage. 
We also facilitate payroll bank account set-up to ensure employees receive their salaries and 
reimbursements smoothly.
Can you arrange equipment for employees?
Yes. With our IT distribution agreements and local staging facilities, we can procure and 
deliver laptops and other equipment on your behalf.
Do you perform background checks?
We can arrange background checks, police clearances, or reference checks at additional cost.
What about resignations and notice periods?
We follow statutory notice periods under Philippine law. If you wish to offer better-than-statutory terms, we can support that.
Do you have headcount requirements?
No. We support businesses from a single employee to large distributed teams - the more the merrier.
Do you manage data security and confidentiality?
Confidentiality, NDAs, and data handling policies are the client’s responsibility. We provide the employment framework, but sensitive data agreements should be managed directly with your employees.
Do you help with government audits?
If a labor audit or inspection arises, Benchmark 365 will supply all necessary employment 
records and documentation to support compliance. Disputes requiring legal counsel remain the responsibility of the client. We can refer you to a locally accredited representative, and you will be responsible for any costs associated with their services.
